ELIGIBILITY

The Giveaway is open only to individuals who are twenty-one (21) years old or older and who are not employees of Common C Services LLC (Common Citizen), Tyson 2.0, Inc. (Tyson 2.0) or any of their affiliates, parent companies, or subsidiaries, or the household members or immediate family members (including without limitation spouses, parents, siblings, or children) of any of the above. Void outside the United States or where prohibited by law.

TIMING

The Giveaway begins on 04.23.2022 and ends on 08.20.2022 at 11:59 PM EST. The drawing will be held on or before 01.09.2022. If applicable, the prize will be available for pick-up on 02.09.2022 or mailed directly to winner. The delivery method will be at the Common Citizen and Tyson 2.0‘s discretion. With respect to the Grand Prize, which includes a tour, Common Citizen and Tyson 2.0 will schedule the tour according to its schedules and will provide as much advance notice as possible. The tour may be postponed or rescheduled at Common Citizen or Tyson 2.0’s sole discretion.

HOW TO ENTER

To enter, entrants must meet the eligible age criteria and comply with these Terms and Conditions. Members visiting any open Common Citizen location in Michigan who purchase a Tyson 2.0 product will be automatically entered. Entrants may also visit https://contest.commoncitizen.com/tyson/ (this landing page) between 04.23.2022 and 08.20.2022 and enter information and full name, birthday, email, and phone number to enter. Loyalty membership required. NO PURCHASE NECESSARY.

WINNER DETERMINATION AND ODDS

The winner(s) will be randomly selected by a computer algorithm from a list of entrants on or before 01.09.2022. The winner(s) will be notified via their preferred contact method provided during entry. The odds of winning the prize are dependent on the number of entries.

A prize will be awarded only if the potential prize winner fully complies with these Terms and Conditions. All prizes are awarded “as-is” with no warranty or guarantee, either express or implied, by Sponsor. Prizes or coupons may not be combined with any other coupon, offer, or discount code. The above prizes are specific to the respective winner(s) and are non-transferable without the consent of Sponsor. Sponsor shall have sole and final decision over all matters related to the drawing. Prizes have no cash value. No cash or credit redemption, assignment, transfer or substitution of any prize or portion thereof is permitted. Prize must be claimed within thirty (30) days of having been notified. If the winner is unable to redeem their prize during the applicable time period, the prize will be forfeited. Sponsor reserves the right to substitute the listed prize (or portion thereof) for one of comparable or greater value. Winner is responsible for all taxes and fees associated with prize receipt and/or use. All federal, state and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the winner. GENERAL CONDITIONS

Winner may be required to complete and execute an Acceptance Affidavit, Release of Liability, and where lawful, a Publicity Release as a condition of receiving the prize. Failure to timely complete and return the above documents may result in disqualification and forfeit of the prize awarded. By accepting the prize, where permitted by law, Winner grants to Sponsor and their agents an unfettered right of publicity, including without limitation the right to use and publish Winner‘s name, likeness, and voice for advertising, trade, and promotional purposes without additional consideration and without notice, review, or approval. Sponsor reserves the right to disqualify and/or revoke any prize awarded to any individual it finds to be acting in violation of these Terms and Conditions or acting in a disruptive manner or with the intent to annoy, abuse, threaten or harass any other person.

RELEASE OF SPONSOR; INDEMNIFICATION

Each entrant agrees to: (a) comply with and be bound by these Terms and Conditions and the decisions of Sponsor, which are binding and final in all matters relating to this Giveaway; (b) defend, indemnify, release and hold harmless the Sponsor and their respective parent, subsidiary, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Giveaway, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Giveaway, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry.

Sponsor and their subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Terms and Conditions; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Giveaway or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Giveaway or any promotion or prize related activities. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Giveaway, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Giveaway, including the entire Giveaway, and/or modify the Giveaway and/or award the prize from all eligible entries received as of the termination date.

LIMITATION OF DAMAGES; CHOICE OF LAW

Under no circumstances will entrant be permitted to obtain, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages or form of relief. In consideration for entering the Giveaway, ALL ENTRANTS CONTRACTUALLY AGREE THAT ANY AND ALL CLAIMS for damages of any nature regarding an alleged incident, including without limitation all questions concerning the construction, validity, interpretation, and enforceability of the Terms and Conditions shall be GOVERNED BY MICHIGAN LAW and EXCLUSIVE JURISDICTION shall be in the courts of the City Detroit, Michigan.
